第三者アーカイブ資料のリファレンス検索ツールとして Curiotheca を利用する際の規約です。 The terms for using Curiotheca as a reference search tool for third-party archive materials.

Curiotheca は、第三者アーカイブからパブリックドメインおよびオープンライセンスの参考画像を見つけるためのツールです。WEB アプリを利用することで、アーカイブ資料を責任を持って利用し、帰属表示、再利用、商用利用、文化的文脈が重要な場合には原典ページを確認することに同意したものとします。Curiotheca helps users discover public-domain and open-license reference images from third-party archives. By using the web app, you agree to use archive materials responsibly and check the original source page when attribution, reuse, commercial use, or cultural context matters.

利用料金Pricing

Curiotheca は現在、すべての機能を無料で提供します。将来のバージョン（v1.0 以降）で有料の Pro 機能が追加される可能性がありますが、現在の WEB アプリは費用なしでご利用いただけます。Curiotheca is currently free to use. A paid Pro tier may be introduced in a future release (v1.0 or later). The current web app has no cost.

Curiotheca の役割Role of Curiotheca

Curiotheca は発見とワークフローのためのツールです。検索結果、原典リンク、権利ラベル、画像操作を WEB アプリにまとめますが、元のアーカイブ記録を確認することの代替にはなりません。Curiotheca is a discovery and workflow tool. It brings search results, source links, rights labels, and image actions into a web app, but it does not replace checking the original archive record.

Curiotheca は Yawaraka Studio が開発した独立したツールです。Metropolitan Museum of Art、Europeana、Art Institute of Chicago、Rijksmuseum、国立国会図書館、生物多様性遺産図書館 (BHL)、その他いかなるアーカイブ機関とも提携・承認・後援の関係になく、それらの機関が公式に提供するツールではありません。各作品の利用条件は、必ず原典ページで確認してください。Curiotheca is an independent tool by Yawaraka Studio. It is not affiliated with, endorsed by, sponsored by, or officially provided by the Metropolitan Museum of Art, Europeana, the Art Institute of Chicago, the Rijksmuseum, the National Diet Library, the Biodiversity Heritage Library, or any other archive. Always verify the terms of use for each work at its original source page.

第三者アーカイブThird-Party Archives

作品メタデータ、画像、権利表示、原典ページは外部アーカイブによって提供されます。Curiotheca はそれらの資料を所有しておらず、すべての第三者記録が完全、最新、または誤りがないことを保証できません。Artwork metadata, images, rights statements, and source pages are provided by external archives. Curiotheca does not own those materials and cannot guarantee that every third-party record is complete, current, or error-free.

責任ある利用Responsible Use

対象資料が自身のプロジェクトに適しているかどうかは、利用者自身の責任で確認してください。特に商用利用、帰属表示、プライバシー、パブリシティ、商標、文化的配慮が関わる場合は注意が必要です。原典ページが Curiotheca の要約より具体的な指示を示している場合は、原典ページの内容が優先されます。You are responsible for confirming whether a source item is appropriate for your project, especially for commercial work, attribution requirements, privacy, publicity, trademark, and cultural sensitivity. When a source page gives more specific instructions than Curiotheca's summary, the source page controls.

サービスの利用可能性Service Availability

検索の可用性、画像の可用性、アーカイブ API の挙動は予告なく変更される場合があります。一部のアーカイブでは、リクエスト制限、記録の削除、画像 URL の変更、権利表示の改訂が行われる場合があります。Search availability, image availability, and archive API behavior may change without notice. Some archives may rate-limit requests, remove records, change image URLs, or revise rights statements.

保証の否認・責任制限No Warranty and Limitation of Liability

WEB アプリおよびランディングサイトは現状有姿で提供されます。法令で認められる最大限の範囲で、Yawaraka Studio は継続的な動作、検索の完全性、メタデータの正確性、特定プロジェクトへの適合性について保証しません。The web app and landing site are provided as is. To the fullest extent permitted by law, Yawaraka Studio disclaims warranties about uninterrupted operation, search completeness, metadata accuracy, and fitness for a particular project.

Curiotheca が表示する権利ラベルおよび原典リンクは参考情報であり、法的助言、著作権クリアランス、または素材の利用許諾を構成するものではありません。法令で認められる最大限の範囲で、Yawaraka Studio はサービスの利用から生じる間接的・付随的・派生的損害または逸失利益について責任を負いません。Rights labels and source links provided by Curiotheca are for reference only and do not constitute legal advice, copyright clearance, or permission to use any material. To the fullest extent permitted by law, Yawaraka Studio will not be liable for indirect, incidental, consequential, or lost-profit damages arising from use of the service.

著作権侵害の申告（DMCA）Copyright Infringement Claims (DMCA)

Curiotheca は米国デジタルミレニアム著作権法（DMCA）に基づく著作権侵害申告に対応します。指定代理人は以下のとおりです。Curiotheca responds to notices of alleged copyright infringement in accordance with the U.S. Digital Millennium Copyright Act (DMCA). Our designated agent is:

有効な申告には以下を記載してください。(1) 著作権者または代理人の電子署名または直筆署名、(2) 侵害されたとする著作物の特定、(3) 侵害されているとするコンテンツの URL、(4) 申告者の氏名・住所・電話番号・メールアドレス、(5)「問題のコンテンツの利用が著作権者、その代理人、または法律によって許可されていないと誠実に信じる」旨の宣言、(6)「申告内容は正確であり、著作権者または代理人として虚偽申告については偽証罪が適用されることを宣誓する」旨の宣言。A valid DMCA notice must include: (1) a physical or electronic signature of the copyright owner or authorized representative; (2) identification of the copyrighted work claimed to have been infringed; (3) the URL of the allegedly infringing content; (4) your name, address, telephone number, and email address; (5) a statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; (6) a statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

反対申告: コンテンツが削除または無効化され、誤りであると判断した場合は、上記の連絡先に反対申告を送ることができます。Counter-Notification: If you believe content was removed or disabled in error, you may submit a counter-notification to the contact above.

繰り返しの侵害: 著作権侵害の申告を繰り返し受けたユーザーへのサービス提供は停止します。Repeat Infringers: We will terminate service to users who are subject to repeated copyright infringement claims.

準拠法・紛争解決Governing Law and Disputes

本規約は日本法に準拠し、解釈されます。本規約に関する紛争は、まず誠実な交渉による解決を試みるものとします。交渉によっても解決できない場合は、東京地方裁判所を第一審の専属的合意管轄裁判所とします。These Terms are governed by and construed in accordance with the laws of Japan. Any dispute arising from these Terms will first be attempted to be resolved through good-faith negotiation. If negotiation fails, the Tokyo District Court shall have exclusive jurisdiction as the court of first instance.

ただし、本条項はお住まいの国の法律上放棄できない消費者保護、データ保護、その他の強行法規上の権利を制限するものではありません。Nothing in these Terms limits any non-waivable consumer protection, data protection, or other mandatory rights you may have under the laws of your country of habitual residence.
